Terms of export and sale

The framework these pages sit inside. The binding terms of any shipment are the ones in the signed contract.

  1. 01

    Contract precedence

    Nothing on this website constitutes an offer. Supply is governed by the written sales contract or order confirmation signed between Abou El Fotouh Farms and the buyer. Where this site and that contract differ, the contract prevails.

  2. 02

    Incoterms

    Deliveries are quoted and performed under the Incoterms rule named in the contract — commonly FOB, CFR or CIF from the Egyptian load port. Risk and cost transfer as that rule provides.

  3. 03

    Specifications

    Produce is supplied against the specification sheet referenced in the contract. Sheets published on this site are indicative and are superseded by the version attached to your order.

  4. 04

    Quality and claims

    Condition at the point where risk transfers is evidenced by the inspection and phytosanitary certificates issued at the port of origin. Claims must be notified within the period stated in the contract and supported by evidence taken at discharge.

  5. 05

    Availability and seasons

    Harvest windows shown on this site are indicative. Volumes, calibres and delivery dates are confirmed per booking.

  6. 06

    Governing law

    Contracts are subject to the law and the jurisdiction stated in the signed contract.
